The Employment Appeal Tribunal (EAT) has stressed that the statutory grievance procedures do not apply in cases where the dispute results in the employee's dismissal.

In cases where the statutory grievance procedures apply, before bringing a claim the employee must commence the procedure by putting the complaint in writing and sending it to the employer (Employment Act 2002, section 32(2)).
